General Terms & Conditions of Sale

These general conditions govern online purchases made through the argentariostore.com Website. Please read these terms and conditions carefully before ordering any products. By ordering any of our products, you agree to be bound by these terms and conditions.


1. GENERAL PROVISIONS

1.1. The general conditions of sale (hereinafter, "General Conditions") govern all sales of Argentario Golf Resort & SPA products (hereinafter, "Products" or "Product") concluded online on the argentariostore.com Website.

1.2. The online selling service governed by the General Conditions is reserved exclusively for consumers (hereinafter, "Customers" or "Customer"); by 'consumers' we mean any individual over the age of 18 who is acting for purposes which are outside his or her trade, business or profession.

1.3. The languages used for the conclusion of sales contracts through this Website are Italian and English.

1.4. Customers are required to carefully read the General Conditions available on the Website. Contracts concluded with customers will be archived by Edilmarina srl for the time required by current legislation.

3. INFORMATION ABOUT THE PRODUCTS AND THEIR AVAILABILITY

3.1. The information relating to the Products, together with the Product codes and their price, are available on the Website.

3.2. The Products available on the Website represent a selection of the items normally available in the store; however, Argentario Golf Resort & SPA does not guarantee the Customer that the Products available on the Website are also present in the store. The graphic representation of the Products displayed on the Website may differ from reality; the Customer must therefore rely exclusively on the description of the Product and the characteristics of the same reported on the Website.

3.3. Argentario Golf Resort & SPA reserves the right to limit, at any time, the quantity and/or type of Products that can be purchased on the Website. The style, models and colours of the Products described on the Website may be changed without notice. During the purchase procedure, if it is not possible to process the order due to the unavailability of the ordered Product, the Customer will be notified. The Seller cannot under any circumstances be held liable to the Customer due to the unavailability of a Product.

3.4. The Customer may insert in the order proposal a maximum quantity determined by the Seller for each Product.

3.5. The Seller is in no case responsible for any errors resulting from the failure of the Client's connection to the Website.


4. PRICE

4.1. The price of the Products indicated on the Website is expressed in Euros and is inclusive of all applicable taxes or duties. Delivery costs must be added to the price of the Products, indicated separately in the order form.

4.2. Argentario Golf Resort & SPA constantly checks the accuracy of the prices indicated on the Website; however, it is not possible to guarantee the absence of errors. If an error is found in the indication of the price of a Product, Argentario Golf Resort & SPA will reject the order and offer the Customer the opportunity to purchase the Product at the correct price

.4.3. There is no "Minimum order" net of discounts, active promotions, shipping costs.


5. CONCLUSION OF THE CONTRACT

5.1. The Website reports the essential characteristics and the price of each Product. The information on the Website does not constitute an offer by Argentario Golf Resort & SPA.

5.2. Before sending an order proposal through the Website, the Customer is required to carefully read all the instructions provided during the purchase procedure (also regarding delivery costs, the conditions for exercising the right of withdrawal and the Privacy Policy) as well as these General Conditions.

5.3. To purchase a Product, the Customer must:

  • insert the selected Product in the "Cart" by clicking on the dedicated button,
  • fill in the order proposal,
  • select the payment method,
  • accept the General Conditions
  • send the order proposal to Argentario Golf Resort & SPA through the Website.

5.4. The transmission of the order proposal constitutes a purchase proposal relating to the selected Product, governed by these General Conditions and binding for the Customer. The transmission of the order proposal by the Customer entails the obligation of the latter to pay the price of the ordered Product or Products.

5.5. Before submitting the order proposal, the Customer can make any corrections/changes to the data entered by following the appropriate procedure indicated on the Website (to make just one example: the Customer has the right to change the quantity of the Products that he intends to purchase by adding or deleting one or more Products from the "Cart").

5.6. Notwithstanding the use of personal data described in the Privacy Policy, the form with the order proposal and the customer data relating to the order proposal may be kept by the Seller for the time required by current legislation.

5.7. The contract between the Seller and the Customer is concluded when the Customer receives confirmation from the Seller of the acceptance of the order proposal forwarded through the procedure provided on the Website. The acceptance (or rejection) by the Seller of the order proposal will be sent to the Customer at the e-mail address indicated by the Customer in the order proposal ("Order Confirmation").

5.8. Argentario Golf Resort & SPA may refuse an order proposal (in this case no amount will be due by the Customer to the Seller except, possibly, the sums indicated under article 6) in the following cases:

  • (I) in case of unavailability of the Products; or
  • (II) if the payment made by the Customer is not successful (by way of example, in the event of failure to charge the purchase price on the Customer's credit card); or
  • (III) if there is a report, or suspicion, of fraudulent or illegal activity, including the suspicion that purchases are made for commercial purposes; or
  • (IV) in case of non-fulfilment by the Customer of his obligations deriving from a previous contract concluded with Argentario Golf Resort & SPA.

5.9. In case of unavailability of one or more ordered products, the customer will be notified by e-mail. In this case, the order proposal is cancelled, or accepted only for the available Products. In case of partial acceptance, the Customer is required to pay only the price for the available Products (if the payment is made by credit card, the Customer will be charged only the amount corresponding to the available Products).

5.10. The Order Confirmation will contain a summary of the essential characteristics of the Products purchased, a detailed indication of the price and payment methods, information relating to delivery costs. Later, an e-mail communication will be sent by the Seller confirming the shipment of the Products ("Confirmation of Shipping").

5.11. The risk of loss or damage of the Products is transferred to the Customer when the latter (or a third party designated by the Customer and other than the carrier) materially comes into possession of the Product.


6. PAYMENT METHOD

6.1. The Customer will be able to pay the amount relating to the Products contained in the order proposal and the shipping costs via NEXI bank gateway.

6.2. The Seller accepts payments made using the following credit cards

  • Visa;
  • MasterCard;
  • American Express;
  • Maestro.

6.3. Transactions will be debited to the Customer's credit card only after:

  • (I) the credit card details have been verified;
  • (II) the debit authorization has been received from the company issuing the credit card used by the Customer.

6.4. If, for any reason, within 10 (ten) working days from the date of the order it is not possible to charge the credit card with the amounts due by the Customer, it will not be possible to execute the contract and the order is considered cancelled.


7. TRANSPORT AND DELIVERY

7.1. The Products will be delivered to the address indicated by the Customer in the order proposal. At the time of delivery, the signature of the Customer (or his delegate) is required. No deliveries are made to post office boxes.

7.2. For each order, the Seller will issue a specific purchase receipt which will be sent to the Customer by e-mail or by post in compliance with current legislation. The purchase receipt is issued based on the information provided by the Customer at the time of the order. Changes to the purchase receipt are not permitted after its issue. The invoice must be requested before the purchase is concluded. After the closing of the order, no invoices can be requested.

7.3. Delivery costs are charged to the customer and are shown separately in the order form.

7.4. The purchased products will be delivered by the courier selected by the Seller (hereinafter "Courier") on working days (therefore excluding Saturdays, Sundays and local or national holidays).

7.5. The Customer (or his delegate) is required to check, upon delivery of the Products by the Courier:

  • (I) that the number of packages delivered corresponds to that indicated in the delivery note; And
  • (II) that the packaging and its seals are intact, not damaged, not wet or altered in any way.

Any damage to the packaging and/or the Product or the mismatch in the number of packages or information must be immediately reported in writing on the Courier's delivery note. Once the Courier's document has been signed without the Customer having raised any objections, the Customer will not be able to make any objection about the external characteristics of the delivered package.


8. TIMES AND SHIPPING COSTS

8.1 The shipment of the products is carried out by the courier selected by the Seller, for which a shipment tracking service is active. The Seller will not be responsible for any malfunctions in the delivery service by the courier. In case of deliveries made at receptions (with signature for collection by the receptionist), the Seller will not be held responsible for subsequent non-deliveries of the package to the final recipient. If a destination country does not appear among those listed, it means that there is currently no delivery of products in that country. However, since the Seller is considering extending the list of countries to which to ship, we recommend that you contact us if you wish to make an order.


8.2 SHIPPING COSTS

The amount of the shipment is calculated at checkout based on the type of product and the country of destination of the order.


8.3 SHIPPING TIMES

The shipping of the products takes place within 5 working days from the date of receipt of the order if the latter is made by 11 am on a working day. Any delivery delays may be caused by the temporary unavailability of the products, by malfunctions in the service by the courier, by causes of force majeure or in case of holidays. The delay in shipping may be caused by the inability to withdraw the authorized payment amount. In case of non-receipt of the goods within 10 working days (excluding Saturdays and Sundays), please contact customer service at info@argentariostore.com.

The delivery times indicated by the Seller must be considered as purely indicative and a delay does not entitle the Customer to refuse the delivery itself and to request compensation.


9. CONFIRMATION OF SHIPMENT AND DELIVERY

9.1. Argentario Golf Resort & SPA will send the customer an e-mail confirming the shipment after the products have been shipped.


10. PACKAGING  

10.1. The Products purchased on the Website are delivered using the normal packaging used by the seller.


11. RIGHT OF TERMINATION

11.1. The Customer has the right to terminate the contract, without specifying the reason, within 14 (fourteen) days from the date on which the Customer (or his authorized representative for receipt of the Product) materially comes into possession of the Product itself.

11.2. To exercise the right of termination, the Customer must carry out the following procedure, within the period provided for in article 11.1:

  • the user must write by email to: info@argentariostore.com;
  • the customer care will verify the request and start the return procedure;
  • the customer receives an e-mail notification from the store indicating: the approval of the return containing the identification number, the directions for shipping the package, and the instructions about a document to be printed and attached to the package.

11.3. Within 14 (fourteen) days from the notice of termination the Customer must return the purchased Product to the Seller by sending it to the following address: Argentario Golf Resort & SPA, Via Acquedotto Leopoldino Snc, Monte Argentario, GR 58019. The costs for returning the Product to the Seller are charged to the Customer. The Customer is solely responsible for any decrease in the value of the Product resulting from handling the Product other than what is necessary to ascertain its nature, characteristics and functioning: therefore, the Customer is required not to remove any labels applied to the Product. The product must be returned intact without tampering and manipulation.

11.4. The Seller will reimburse the sums corresponding only to the purchase of the product for sale and not the additional costs, no later than 30 (thirty) days from the date on which the Seller was informed of the Customer's decision to withdraw from the contract. This reimbursement will be made by the Seller with the same payment methods used by the Customer for the initial transaction, unless otherwise expressly agreed between the parties and provided that the Customer does not have to incur additional expenses for such reimbursement. If the purchase was made using a discount code, the amount of the discount will not be refunded. The refund will only relate to the amount that was actually spent.

11.5. The Seller may suspend the refund until the returned Product has been received.

11.6. After the shipment of the Product, the order can no longer be cancelled or modified. The return of Products already shipped must in any case be carried out under the procedure provided for in this article 11.


12. PERSONALIZED PRODUCTS AND GIFT CARDS

12.1. The right of termination does not apply to orders relating to customized products such as, by way of example, Products on which the Customer's initials are engraved. 

12.2. It is not possible to request refunds for Gift Cards (digital or paper vouchers).


13. REPLACEMENT OF PRODUCTS

To exchange one item for another, the Customer must first return the original item within 14 (fourteen) days from receiving it and then place a new order. The Customer will be refunded for the original item following the return policy specified in these Terms & Conditions. 


14. CONFORMITY DEFECTS

14.1. If a product sold by Argentario Golf Resort & SPA should have a manufacturing defect or a lack of conformity relating to Products sold on this Website, the Customer is required to immediately contact the assistance by e-mail info@argentariostore.com.

14.2. The sale of the Products is subject to the legal guarantees provided for in articles 129, 130 and 132 of the Consumer Code. Under these regulatory provisions, the Customer has the right to obtain the conformity of the goods through the repair or substitution of the product as specified by the law, without any expense to be borne by him or, if one of these remedies is not successful, he will be able to obtain an appropriate price reduction of the Products or the termination of the contract. The Customer loses these rights if he does not report the lack of conformity to the seller within 2 (two) months from the date on which he discovered a lack of conformity. The direct action to assert a lack of conformity not intentionally concealed by the seller is prescribed within 26 (twenty-six) months from the delivery of the product.

14.3. If the Customer requests the repair or replacement of the Product due to a lack of conformity of the Product, the shipping costs will be paid by Argentario Golf Resort & SPA.


15. GUARANTEE OF AUTHENTICITY AND INTELLECTUAL PROPERTY RIGHTS

15.1. Argentario Golf Resort & SPA guarantees the authenticity of all Products purchased on the Website.

15.2. The "Argentario Golf Resort & SPA" and "Argentario Golf Club" brand, as well as the set of figurative and non-figurative trademarks and service marks, present on the Products, on the related accessories and/or packaging, whether they are subject to registration or not, as well as all illustrations, images and logos protected by copyright, and, more generally, all intellectual property rights relating to the Products are and remain the exclusive property of the following company: Edilmarina srl.


16. RETURNS AND REFUNDS

To exercise the right of return, the Customer must carry out the following procedure, within the period provided for in article 11.1:

  • the user must write by email to: info@argentariostore.com;
  • the customer care will verify the request and start the return procedure;
  • the customer receives an e-mail notification from the store indicating: the approval of the return containing the identification number, the directions for shipping the package, and the instructions about a document to be printed and attached to the package.

The Customer must return the products to Argentario Golf Resort & SPA at his own expense within 14 (fourteen) days of sending the termination email, to the following address: Argentario Golf Resort & SPA, Via Acquedotto Leopoldino Snc, Monte Argentario, GR 58019. 

The Product must be returned intact, complete with all its parts and in the original packaging (envelopes and packages) in compliance with the following conditions:

  • the right of return may apply to the product purchased in its entirety;
  • for the refund to be possible, the product must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, seals, etc ...);
  • the shipping costs (and any customs fees if applicable) for the return of the goods will be the sole responsibility of the Customer;
  • the shipment, up to the receipt of the Product by the Seller, is under the complete responsibility of the Customer;
  • in case of damage to the goods during transport, the Seller will notify the Customer, to allow him to promptly file a complaint against the courier chosen by him and obtain the relative reimbursement; the product will then be made available to the customer, simultaneously cancelling the request for termination;
  • the Seller will not be liable in any way for damage, theft or loss that occurred during or depending on the return shipment.

Argentario Golf Resort & SPA will reimburse the sums corresponding only to the purchase of the product for sale and not the additional costs, no later than 30 (thirty) days from the date on which the Seller was informed of the Customer's decision to withdraw from the contract, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. If the purchase was made using a discount code, the amount of the discount will not be refunded. The refund will only relate to the amount actually spent. Argentario Golf Resort & SPA may suspend the refund until the returned product is received.

In any case, the Customer will lose the right of refund in the case where Argentario Golf Resort & SPA ascertains that:

  • the returned product and/or its accessories, and/or its packaging are not intact;
  • the product is missing its external packaging and/or original internal packaging;
  • the product lacks integral elements and/or accessories.

In case of forfeiture of the right of termination, Argentario Golf Resort & SPA will return the purchased product to the sender, charging the shipping costs to the sender and, if already reimbursed, the price of the product. 


17. APPLICABLE LAW AND JURISDICTION

17.1. These General Conditions and, consequently, the contracts concluded with the Customers, are governed by Italian law and must be interpreted based on it (including Legislative Decree No. 206 of 6 September 2005 "Consumer Code" and the Legislative Decree no. 70 of 9 April 2003 "E-commerce Decree").

17.2. Any dispute arising from the interpretation, validity and/or execution of these General Conditions will be devolved to the mandatory jurisdiction of the judge of the place of residence of the Customer.
